- Trade Marks: A mark is used or proposed to be used in relation to goods for the purpose of indicating, or so as to indicate, a connection in the course of trade between the goods and some person having the right either as proprietor or registered user to use the mark whether with or without any indication of the identity of the person.
Registration of a Trade Mark entitles the proprietor to institute proceedings for the infringement of Trade Marks and accordingly obtain damages. However this does not prejudice an applicant’s right to sue for passing off under common law (APPLICABLE IN SOME WEST AFRICAN COUNTRIES).
- Patents: Patents can generally be described as the right granted to an inventor by a State, or by regional office acting for several States, which allows the inventor to exclude anyone else from commercially exploiting his invention for a limited period, usually 20 years.
- Designs: Any combination of lines and colours or both and any three – dimensional form whether or not associated with colours, if it is intended by the creator to be used as a model or pattern to be multiplied by industrial process and is not intended solely to obtain technical result
